On May 29, a U.S. federal appeals court temporarily reinstated former President Donald Trump’s broad “Liberation Day” tariffs, just a day after the U.S. Court of International Trade ruled them unconstitutional. The lower court found Trump had overstepped his authority by using the International Emergency Economic Powers Act to impose tariffs, arguing that Congress only has the constitutional power to levy taxes. The appeals court’s stay allows the tariffs, including those targeting Canada, Mexico, and China over fentanyl-related claims, to remain in place while the case proceeds. Briefs are due by June 9.
